Predict the Oscar Winners 2008 Sweepstakes

To enter this Sweepstakes, you must agree to and abide by these Official Rules.

NO PURCHASE NECESSARY TO ENTER OR WIN.

1. Sweepstakes Entry: The Sweepstakes begins 12:01am PT on 1/25/08 and ends 1:00pm PT on 2/24/08. To enter, navigate the Internet to www.oscar.com and click on the icon which will take you to the "Predict the Oscar Winners" Sweepstakes home page. You will be asked to provide your name, address, birthdate, e-mail address and phone number. Then, complete your entry by providing your predictions for the winning nominee in each of the 24 award categories at the 80th Annual Academy Awards. You may select only one (1) nominee per category. Send your entry by clicking the submit link on the Sweepstakes page. You may be asked to consent to receive promotional e-mails and reminders for upcoming promotions from the WDIG Family of Sites or ABC Multimedia, Inc. Consenting to receive promotional or reminder e-mails is optional and does not have to be agreed upon in order to be eligible to enter the Sweepstakes, and does not improve your chances of winning. Once registered, you may return to your form (and resubmit it) as many times as you wish to revise your predictions before the Sweepstakes entry period ends. All online entries/changes must be received by 1:00pm PT 2/24/08. The last (online) entry received from you before the Sweepstakes ends (1:00pm PT 2/24/08), as per Sponsor’s records, will be considered your only entry. ABC’s computer will be considered the official clock of the Sweepstakes. Limit one (1) online entry per person or e-mail address. Multiple or mass online entry attempts will be disqualified. No automatically generated entries will be accepted. Entries must be manually key-stroked; use of automated entry devices or programs is prohibited. It is the sole responsibility of the entrant to notify LeadDog Marketing Group, Inc. ("LD") in writing if the entrant changes his/her e-mail address after submission of online entry. All entries become the property of Sponsor and will not be acknowledged or returned.
2. Eligibility: Sweepstakes is open only to legal residents of the 50 United States and Washington D.C., who are 18 years of age or older. Any individuals (including but not limited to employees, consultants, independent contractors, and interns) who have, within the past six months, performed services for American Broadcasting Companies, Inc. ("ABC"), ABC Multimedia, Inc., Walt Disney Internet Group ("WDIG"), the Academy of Motion Picture Arts and Sciences, LeadDog Marketing Group, Inc., any organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the sweepstakes or supplying the prizes, and/or each of their respective parents, affiliates, parent corporations and subsidiaries, and immediate family and household members of such individuals, are not eligible to enter or win. "Immediate family members" shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses. "Household members" shall mean people who share the same residence at least three months a year. Potential winner may be required to provide proof of legal U.S. residency upon request prior to prize award. By participating in this sweepstakes, entrants agree to release, discharge, and hold harmless ABC, ABC Multimedia, Inc., WDIG, the Academy of Motion Picture Arts and Sciences, and LeadDog Marketing Group, advertising and promotion agencies and prize suppliers, their respective parent, subsidiary, affiliated and successor companies, and each of their respective officers, directors, agents, representatives and employees, as well as each of their respective successors, representatives and assigns (collectively, the "Released Parties") from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this sweepstakes, use of the information submitted on the Sweepstakes home page, and/or acceptance or use of the prize. By entering this Sweepstakes, you grant permission to the above Released Parties to use your name, photograph, likeness, voice, prize information and/or biographical information (city and state only) for programming, publicity and promotional purposes without compensation, unless prohibited by law. Sweepstakes subject to the laws of the United States only. All federal, state and local laws and regulations apply. Void where prohibited. Participation in the Sweepstakes constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules.
3. Prizes: One (1) Grand Prize: Winner will receive one woman’s Kwiat Diamond Right-hand Ring valued at $5,800 and one set of men’s Kwiat Diamond Cufflinks valued at $6,000. Setting, color, cut and carat size of the prizes are at sponsor’s sole discretion. Approximate retail value of Grand Prize: $11,800.00. Value indicated herein does NOT represent resale value of prize. Odds of winning depend on the number of eligible entries received as well as a given entrant’s knowledge of the films (and the actors, directors, producers and other creative personnel involved with the development and production of such films) considered by the Academy of Motion Picture Arts and Sciences for receipt of its 2008 Oscar® award as compared to other entrants’ knowledge of such subject matter. No substitution or transfer of prize except with Sponsors’ permission or where required by law. All eligibility determinations shall be at Sponsors sole discretion and are final and binding. If for any reason announced prize (or prize component) becomes unavailable (as determined by Sponsor in its sole discretion), Sponsor may award a substitute prize/prize component of equal or greater value. Prizes are not redeemable for cash. All taxes and expenses are the sole responsibility of winner. Prize will only be delivered to address within the United States. Winner will receive a 1099 tax form reflecting actual value of any prize valued at $600 or more.

No substitution or transfer of prize except with Sponsors’ permission or where required by law. Academy Awards bleacher seats are non-transferable and have no retail value. To be eligible to participate in the Sweepstakes, Entrants may not have been convicted of a felony, have criminal charges pending against them. All eligibility determinations shall be at Sponsors sole discretion and are final and binding. Entrant understands and agrees that, if selected as the Grand Prize winning Entrant, he/she may be required to consent to a background check; and, failure to sign such consents and authorizations and/or to furnish all required information will result in disqualification and prize forfeiture. Grand Prize winner must be able to travel so as to use 80th Academy Awards bleacher seats; if Grand Prize winner is unavailable to travel at such time, Grand Prize winner will be disqualified and an alternate winner selected. Grand Prize winner and guest must travel together on same itinerary. If for any reason announced prize (or prize component) becomes unavailable, Sponsor may award a substitute prize/prize component of equal or greater value. Prizes are not redeemable for cash. All taxes and expenses not specified in these Official Rules are the sole responsibility of winner. Prize will only be delivered to address within the United States. Winner will receive a 1099 tax form reflecting actual value of any prize valued at $600 or more.

4. Validations/Winner Selection: Entrant with the highest number of correct predictions (of winning nominees at the 80th Academy Awards scheduled for February 24, 2008) for the Sweepstakes will be deemed the Grand Prize Winner. In the event of a tie, the winner will be randomly selected on or about 2/29/08 from all eligible entrants with the same number of correct predictions received. Tabulation of entrants’ correct predictions and random drawing (if necessary) to be conducted by LeadDog Marketing Group, official judging organization, whose decisions are final and binding on all aspects of the Sweepstakes. The correct predictions are those officially sanctioned by the Academy of Motion Picture Arts and Sciences. Potential winner will be notified by e-mail or telephone. Failure to respond to the initial verification e-mail or telephone call within 3 business days after notification or return of e-mail notification as undeliverable after 3 attempts will result in forfeiture of winner status. Grand Prize winner will be required to sign and return within 5 business days of notification an Affidavit of Eligibility, Release and Indemnification, and where allowed by law, a Publicity Release. Failure to return forms within the specified time period may result in disqualification, with an alternate winner being selected. In the event of any dispute concerning the identity of an online entrant, the entry will be deemed submitted by the natural person who is the authorized holder of the transmitting e-mail account "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. If for any reason, the prize is not claimed or the winner is disqualified, prize will be awarded to the entrant with the next highest number of correct predictions or from a random drawing of all eligible entrants with the same highest number of correct predictions. If for any reason whatsoever, the Sweepstakes is not capable of running as planned, including without limitation, cancellation, interruption, disruption or postponement of the 80th Academy Awards, or infection of Sweepstakes by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, Sponsor reserves the right at their sole discretion, to terminate, modify and/or suspend the Sweepstakes and to disqualify any individual who tampers with the entry process or the operation of the Sweepstakes. Without limiting the foregoing, if the 80th Academy Awards broadcast is interrupted or postponed from its original broadcast date due to labor issues/work stoppage, natural cataclysm, state of emergency, or any other force majeure event (such that the broadcast cannot be shown in its entirety as originally intended by Sponsor and the Academy of Motion Picture Arts and Sciences), Sponsor reserves the right to modify or suspend the timing, entry deadline and prize award schedule of the Sweepstakes such that they will correspond to the scheduled new broadcast (or re-broadcast, if applicable) date of the 80th Academy Awards (and, in such event, notice will be posted at www.oscar.com). Sponsor also reserves the right to award prize listed in these official rules at random among those eligible individuals who submitted valid entries prior to the time the Sweepstakes was terminated or via some other means determined by Sponsor in its sole discretion to be fair, appropriate and consistent with the spirit of these Official Rules. Notice of such action by Sponsor will be posted on www.oscar.com. By participating, entrants agree to be bound by these official rules and the decisions of the Sponsor and the judges, which shall be final in all respects.
5. Limitations of Liability: Released Parties not responsible for failed, partial or garbled computer transmissions, or for technical failures of any kind, including but not limited to electronic malfunction or damage of any network, hardware or software. Released Parties not responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to or alteration of entries; or any problems or technical malfunctions of any telephone network or cable lines, computer online systems, servers or providers, computer equipment, software, failure of any e-mail or electronic entry to be received on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof, including any injury or damage to participant’s or any other person’s computer related to, or resulting from, participation in or downloading any materials from this Sweepstakes. Sponsor makes no representations or warranties of any kind concerning the safety, quality, appearance, value, performance or any other aspect or characteristic of any prize, the only representations or warranties on the prize being those of the prize supplier. IN NO EVENT WILL THE RELEASED PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE SWEEPSTAKES SITE OR DOWNLOADING ANY MATERIAL THEREFROM. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE SWEEPSTAKES SITE IS PROVIDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
